Petition Filed

Yesterday, plaintiffs Barbara Manzara and Keith Marquard filed suit against the State of Missouri seeking a declaratory judgement that section 99.1205 of the Revised Missouri Statutes violates the Missouri Constitution. Plaintiffs allege serious constitutional defects in the language of the law and contend that the State of Missouri simply cannot afford to unconstitutionally bail out a private interest. A copy of the petition is availble here.

Upon the filing of their lawsuit, Manzara and Marquard issued the following joint statement:

“Corruption of the legislative process bars residents from meaningful participation in determining the future of our State. We turn to the state courts reluctantly and as a last resort. Now, this is a matter for the courts to decide.”

As the suit progresses, this website will feature official updates from the Missouri Constitutional Defense Fund.
